1. Agreement to terms

By accessing or using Loiso AI (“Service”), operated by Loiso AI (“we”, “us”, “our”), you agree to be bound by these Terms and Conditions. If you do not agree, do not use the Service. We may update these terms from time to time; continued use after changes constitutes acceptance.

2. Description of service

Loiso AI provides AI-powered product photography, model campaigns, marketing posters, and related visual content generation. The Service is offered to businesses and individuals, including those based in South Africa, with pricing in ZAR where applicable. Features, credits, and availability may change with notice.

3. Account and eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for keeping your account credentials secure and for all activity under your account. You must provide accurate information and notify us of any unauthorized use.

4. Acceptable use

You agree not to:

• Use the Service for any illegal purpose or in violation of applicable law.
• Upload content you do not have the right to use (e.g. infringing or unauthorized materials).
• Generate content that is defamatory, harmful, or that infringes others’ rights.
• Attempt to reverse-engineer, scrape, or overload our systems.
• Resell or redistribute the Service or outputs in a manner that competes with us, unless agreed in writing.

We may suspend or terminate accounts that violate these terms or for any other reason we deem necessary to protect the Service or others.

5. Intellectual property and licence

You retain ownership of content you upload. By using the Service, you grant us a licence to use, process, and store that content as needed to provide the Service and improve our systems (as described in our Privacy Policy). Subject to your compliance with these terms and any applicable plan, we grant you a limited, non-exclusive licence to use the generated outputs for your business and marketing purposes. We do not claim ownership of your generated images, but our underlying technology, branding, and platform remain our property.

6. Payment, credits, and subscriptions

Paid plans, one-off purchases, and credit packs are charged in the currency stated (including ZAR). Fees are non-refundable except as set out in our Refund Policy. Credits and subscription benefits are for your account only and do not roll over unless otherwise stated in the plan. We may change pricing with reasonable notice; continued use after a price change constitutes acceptance.

7. Disclaimers

The Service is provided “as is”. We do not warrant that it will be uninterrupted, error-free, or fit for any particular purpose. AI-generated content may contain inaccuracies or imperfections. You are responsible for reviewing outputs before use and for ensuring your use complies with law and third-party rights.

8. Limitation of liability

To the fullest extent permitted by law, we and our affiliates shall not be liable for any indirect, incidental, special, or consequential damages, or for loss of profits, data, or business opportunities. Our total liability for any claim arising from these terms or the Service shall not exceed the amount you paid us in the twelve (12) months before the claim. Some jurisdictions do not allow certain limitations; in such cases our liability is limited to the maximum permitted by law.

9. Governing law and disputes

These terms are governed by the laws of South Africa. Any dispute shall be subject to the exclusive jurisdiction of the courts of South Africa, unless we agree otherwise in writing.
